Individual Proxy terms of service

About our service

• Web proxies are, by their very nature, a little slower than browsing the Internet without a proxy. The reason is that all your traffic must first go through our servers, then out to the Internet. This ensures that your traffic is anonymous, but it takes the data a little longer to transfer.
• Not all websites work perfectly with a web proxy. Individual Proxy service works with most sites, but you will come across some that do not. That's part of the nature of web proxies. Because all traffic needs to be re-packaged to be sent to you anonymously, some things will not work perfectly.
• You are responsible for your proxy site's username and password. If you give it out, anyone else's usage counts against your monthly bandwidth limit. It's important to make sure you choose a secure password so that it isn't easily guessed.
• DO NOT use Individual Proxy service to transmit sensitive personal information, such as credit card numbers, social security numbers, or important passwords. We do not guarantee the security of the transmission of such information.

What you are allowed and not allowed to do

• Individual Proxy cannot be used to engage in illegal activity. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation is prohibited.
• We reserve the right to terminate your account, without notice and without refund, if we determine that you are engaging in illegal activity. The determination of what is illegal is at our sole discretion. You agree You will not be entitled to a refund of any fees paid to Individual Proxy if, for any reason, Individual Proxy takes corrective action with respect to your improper or illegal use of our services.
• You may not use Individual Proxy or any of our communication tools to transmit, directly or indirectly, any unsolicited bulk communications (including e-mails and instant messages). You may not induce or allow others to use Individual Proxy to violate the terms of service. We may terminate your access or use of Individual Proxy immediately and take any other legal action if you, or anyone using your access to Individual Proxy, violates these provisions. We may take any technical remedies to prevent unsolicited bulk communications from entering, utilizing, or remaining with in our computer or communications networks.
• You do not own the subdomain or FQDN that Individual Proxy assigns to you. Those remain the property of Individual Proxy.

Warranties and Other Legal Terms

• We guarantee that we do not monitor or log your proxy usage, however, if we receive a court order from a US court, we will comply with it fully. Put simply, if you don't do anything illegal, you're safe with us.
• Because you may be using Individual Proxy service to bypass a corporate, government, or other entity's web filtering and blocking system, using the Individual Proxy service may be against policy or against the law, depending on where you are. You agree that we are not responsible for your use, misuse, or any legal or other ramifications that you may incur due to the use of Individual Proxy. Use at your own risk.
• This site allows children to post or distribute any personally identifiable information without first obtaining verifiable parental consent. This site does not provide children notice of what information is collected. This site does not allow the parent to obtain the information collected from the child and provide a way for the parent to prevent the future use of that information.
• IN NO EVENT SHALL Individual Proxy BE LIABLE TO YOU OR ANY OTHER PERSON FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFIT OR GOODWILL, FOR ANY MATTER, WHETHER SUCH LIABILITY IS ASSERTED ON THE BASIS OF CONTRACT, TORT (INCLDUDING NEGLIGENCE), BREACH OF WARRANTIES, EITHER EXPRESS OR IMPLIED, ANY BREACH OF THIS AGREEMENT OR ITS INCORPORATED AGREEMENTS AND POLICIES YOUR INABILITY TO USE THE SOFTWARE OR SERVICES, YOUR LOSS OF DATA OR FILES OR OTHERWISE, EVEN IF Individual Proxy HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Some states may not allow such a broad exclusion or limitation on liability for damages as contained herein. In such states, Individual Proxy's liability is limited to the full extent permitted by law. You agree that in no event shall Individual Proxy's maximum aggregate liability exceed the total amount paid by You for the particular service in dispute purchased from Individual Proxy.
• Individual Proxy expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose and non-infringement. Services are provided on an "As Is" and "As Available" basis. Individual Proxy makes no warranty that its services will meet your requirements, or that the services will be uninterrupted, timely, secure, or error free, or that defects will be corrected. Individual Proxy does not warrant, nor make any representations regarding the use, or results of, any of the services it provides, in terms of their correctness, accuracy, reliability, or otherwise. Some jurisdictions do not allow the disclaimer of implied warranties, in which event that foregoing disclaimer may not apply to you.
• As consideration for the services purchased by you and provided to you by Individual Proxy, you agree to pay Individual Proxy at the time you order. All fees are due immediately and are non-refundable unless otherwise expressly noted, even if your services are suspended, terminated, or transferred prior to the end of the services term.
• If, at any time, we, Individual Proxy, believe you, the Customer, are in breach of any of the terms and conditions contained in this agreement, we may immediately terminate this agreement without liability.
• In the event of any dispute arising out of or relating to this agreement, such dispute shall be resolved in the State of Michigan, County of Kent, and the prevailing party in any such dispute shall be entitled to reasonable costs, including collection costs, and attorney's fees.
• We may modify these Terms of Service from time to time. You agree that we may do so without notice.
• By using your Individual Proxy service, you indicate that you agree and consent to these terms of service.

Refund Policy

• We strive to provide our users with a superior product and superior privacy protection. If you are unsatisfied with your Individual Proxy service, we will provide a full refund (minus setup fees) within 60 days of the creation of your account.
